Filing Restraining Orders and Protective Orders

If you are experiencing domestic violence, you can seek a protection order in any Idaho State Court. This will create an order from the state right away that requires the defendant (the abuser) to stay a certain distance away from you, your family or your residence. This will be a temporary order, and it will last for 14 days or until a hearing is held to determine whether or not it should stay in place for a longer time.

Defense Against Domestic Violence Accusations

If your spouse files for a restraining order against you, you will no longer be able to go to your home or see your children. Violating the restraining order (even with a phone call) can lead to criminal charges of stalking or aggravated stalking or contempt of court. If you have been charged with domestic violence, talk to a lawyer right away.
