State of Idaho v. Policy

Mr. Policy, a disabled veteran, was charged with felony aggravated assault in Canyon County Case No. CR14-19-1127 for an incident which occurred on New Year's Eve 2018. In the incident, Mr. Policy, who possessed a concealed carry permit for his weapon, was himself assaulted by two individuals at a house in Caldwell. One of the individuals who laid his hands on Mr. Policy filed a police report indicating Mr. Policy had threatened him with his firearm. The penalty for aggravated assault is imprisonment for up to five (5) years, a fine of up to $5,000 or both.
Mr. Policy reached an agreement with the State and pled guilty to misdemeanor disturbing the peace. He received a "withheld judgment" and was sentenced to pay a fine and court costs and was placed on a 6-month period of unsupervised probation. If and when Mr. Policy successfully completes his period of unsupervised probation, his case will be dismissed.
